1. The petitioner is serving in respondent No. 2 – Airports Authority of India [“AAI”], as Member (Air Navigation Services) since 02.09.2021. His initial tenure of five years has come to a close on 01.09.2026. He has filed this petition under Article 226 of the Constitution, challenging a communication dated 10.09.2026 addressed by the Ministry of Civil Aviation [“Ministry”] to the Chairman, AAI. The impugned communication states that the AAI had requested for extension of the petitioner’s tenure until the date of his superannuation i.e. 30.04.2029, but the Competent Authority has decided to forward the proposal for non- extension of his tenure to the Appointments Committee of the Cabinet [“ACC”], for consideration. 2. Mr. Ravi Prakash, learned Senior Counsel for the petitioner, inter alia submits that the Ministry had no jurisdiction to forward a proposal of this nature to the ACC, but only to forward necessary documents for the ACC to take a decision.
3. However, the aforesaid communication has not been addressed to the petitioner and does not appear to constitute a final decision on the question of his extension. It is expressly stated to be a “proposal” and “for consideration” of the ACC.
4. Without entering into the merits of this controversy, at this stage, Mr. Prakash seeks permission to withdraw this writ petition, without prejudice to any contentions available to the petitioner, in the event an adverse decision is ultimately taken against him.
5. Although this contention is not raised in the writ petition, Mr. Prakash submits that the petitioner has not been given any posting or charge after 01.09.2026. As far as this aspect is concerned, he may approach the relevant authorities or take such other remedies as available to him.
6. The writ petition, alongwith pending applications, stands disposed of in terms of the aforesaid. PRATEEK JALAN, J SEPTEMBER 25, 2026 ‘pv’/SM/ This is a digitally signed order.
