1. By the present petition the following prayer are sought: - “1.Issue a writ of Mandamus or any other appropriate writ, Order, or Direction, directing the respondents to issue the relevant permit to the Petitioner’s husband so that he can reunite with his family and cohabit with his wife in India, without any further delay.

2. Pass an Order for issuance of a writ in the nature of mandamus directing the Respondent(s) to remove the name of the Petitioner’s husband, Mr. Sh. Shayak Showkat Beg from the ‘BLACKLIST’ category and consequently restitute his rights to visit his home country.

3. Issue a writ in the nature of mandamus to the Respondents for disclosure of reasons for such arbitrary and sudden change in citizenship status of the Petitioner’s husband and allow an appropriate opportunity to restore the Indian Citizenship of her husband.”

2. The learned counsel for the petitioner submits that since the filing of the present petition, the circumstances have changed. One of the reasons for blacklisting the petitioner’s husband by the FRRO Bangalore, was that he had not surrendered the Indian Passport despite This is a digitally signed order. acquiring Canadian Nationality. He has however, subsequently surrendered the Indian Passport.

3. The learned counsel for the petitioner further submits that another reason for putting the petitioner’s husband name in the blacklist category was that he had, at some point in time, stayed in India despite the Visa having expired. He submits that the petitioner has paid the penalty and was allowed to exit at that time and therefore the same cannot be a ground for continuing an order of blacklisting the petitioner.

4. The learned counsel for the petitioner, in such circumstances, submits that a representation shall be made to the respondent authority for removing his name from the blacklist category.

5. Considering the above, the petition stands disposed of, with liberty to the petitioner to give a fresh representation to the respondent authority.

6. As and when the same is filed, the respondent authority is requested to take decision within a period of six weeks. AMIT MAHAJAN, J SEPTEMBER 24, 2026 DU This is a digitally signed order.
