1. This hearing has been done through hybrid mode.

2. The present petition has been filed under Section 482 of the Code of Criminal Procedure, 1973 read with Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023 [hereinafter referred to as ‘BNSS’], seeking quashing of FIR No. 923/2018 dated 18.09.2018, registered at Police Station Aman Vihar, District Outer, Delhi, for offences under Sections 363, 366, 368, 174- A read with Section 34 of the Indian Penal Code, 1860 [hereinafter referred to as ‘IPC’], Section 6 of the Protection of Children from Sexual Offences Act, 2012 [hereinafter referred to as ‘POCSO Act’ and Sections 9 and 10 of the Prohibition of Child Marriage Act, 2006, and all proceedings emanating therefrom, on the basis of settlement arrived at between the parties.

3. Issue notice. The learned APP for the State accepts notice on behalf of the State.

4. The petitioners and respondent no. 2 are present before this Court and have been duly identified by their respective learned counsels and the concerned Investigating Officer [IO].

5. Briefly stated, the aforesaid FIR came to be registered on the complaint of respondent No. 2, the mother of respondent No. 3, after respondent No. 3, who was then stated to be about 16 years of age, left her home on 18.09.2018 and did not return. The FIR was initially registered under Section 363 IPC and, upon investigation, the other aforesaid offences came to be invoked. It is stated that respondent No. 3 subsequently married petitioner No. 1 and they have since been residing together as husband and wife and have three children. The parties have now amicably resolved their disputes and executed a Memorandum of Understanding [MoU] dated 31.08.2026, pursuant to which respondent Nos. 2 and 3 have stated that they do not wish to pursue the proceedings arising from the aforesaid FIR.

6. On a query made by this Court, respondent Nos. 2 and 3, who have been duly identified by the IO, have stated that they entered into the Memorandum of Understanding [MoU] dated 31.08.2026 of their own free will and without any pressure, coercion, undue influence or threat. They have further stated that they have no objection if the aforementioned FIR is quashed.

7. In view of the above, since the parties have amicably resolved their differences of their own free will and without any pressure, coercion, undue influence or threat, no useful purpose would be served by continuing the proceedings. Rather, continuation of the proceedings may only give rise to further acrimony between the parties. In these circumstances, this Court is of the view that the interest of justice would be served by bringing the proceedings to an end. Accordingly, the aforesaid FIR and all proceedings arising therefrom are liable to be quashed.

8. Accordingly, FIR No. 923/2018 dated 18.09.2018, registered at Police Station Aman Vihar, District Outer, Delhi, for offences under Sections 363, 366, 368, 174-A read with Section 34 IPC, Section 6 POCSO Act and Sections 9 and 10 of the Prohibition of Child Marriage Act, 2006 along with all consequential proceedings emanating therefrom, is hereby quashed.

9. Therefore, the present petition is allowed and thereby, is disposed of.

10. The pending application also stands disposed of.

11. A copy of this order be sent to the concerned learned Trial Court for necessary information and compliance.

12. The order be uploaded on the website forthwith. MADHU JAIN, J SEPTEMBER 24, 2026/ys/PG
