1. This hearing has been done through hybrid mode.

2. The present petition has been filed under Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023 [hereinafter referred to as ‘BNSS’] seeking quashing of FIR No. 202/2016, registered at Police Station Ghazipur, Delhi, under Sections 420, 468, 471 read with 34 of the Indian Penal Code, 1860 [hereinafter referred to as ‘IPC’], and all consequential proceedings emanating therefrom, on the basis of an amicable settlement arrived at between the petitioner and respondent Nos. 2 and 3 respectively.

3. Issue notice. The learned APP for the State accepts notice on behalf of the State.

4. The petitioner, who is present before this Court and respondent nos. 2 & 3, who appear through video conferencing [VC] have been duly identified by their respective learned counsel[s] and concerned Investigating Officer [IO].

5. Briefly stated, the aforesaid FIR was registered on 05.04.2016 on the complaint of respondent No. 2 initially under Section 420 read with Section 34 IPC, alleging that the petitioner had induced him to part with ₹18,000/- in connection with an LIC policy transaction. During investigation, allegations relating to the use of forged documents also surfaced, and the charge-sheet came to be filed under Sections 420, 468, 471 read with Section 34 IPC. Cognizance was taken on 04.03.2021, and the proceedings are presently pending before the learned JMFC-06, Karkardooma Courts, Delhi.

6. During the pendency of the proceedings, the petitioner amicably resolved the disputes with respondent Nos. 2 and 3. Respondent No. 2 received ₹18,000/- under a settlement deed dated 20.01.2018, while respondent No. 3 received ₹49,000/- under a separate settlement deed dated 22.01.2018. Both respondents have also filed affidavits stating that the disputes stand settled and that they have no objection to the quashing of the FIR and the proceedings arising therefrom.

7. On a query made by this Court, respondent Nos. 2 and 3, who have been duly identified by the IO, have stated that they entered into the Settlement Deeds dated 20.01.2018 and 22.01.2018, respectively, with the petitioner, of their own free will and without any pressure, coercion, undue influence or threat. They have further stated that they have no objection if the aforementioned FIR and the proceedings arising therefrom are quashed.

8. In view of the above, since the petitioner and respondent Nos. 2 and 3 have amicably resolved their differences of their own free will and without any pressure, coercion, undue influence or threat, no useful purpose would be served by continuing the proceedings. Rather, continuation of the proceedings may only give rise to further acrimony between the parties. In these circumstances, this Court is of the view that the interest of justice would be served by bringing the proceedings to an end. Accordingly, the aforesaid FIR and all proceedings arising therefrom are liable to be quashed.

9. Accordingly, FIR No. 202/2016, registered at Police Station Ghazipur, Delhi, under Sections 420, 468, 471 read with 34 IPC along with all consequential proceedings emanating therefrom, is hereby quashed.

10. Therefore, the present petition is allowed and thereby, disposed of.

11. Pending application[s], if any, also stand[s] disposed of.

12. A copy of this order be sent to the concerned learned Trial Court for necessary information and compliance.

13. The order be uploaded on the website forthwith. MADHU JAIN, J SEPTEMBER 24, 2026/b/PG
