1. This hearing has been done through hybrid mode.
2. The present petition has been filed under Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023 [hereinafter referred to as ‘BNSS’], seeking quashing of FIR No. 101/2017 dated 04.08.2017, registered at Police Station Crime (Women) Cell, Nanak Pura, for the offences punishable under Sections 498-A, 406, 506 read with Section 34 of the Indian Penal Code, 1860 [hereinafter referred to as ‘IPC’] and all proceedings emanating therefrom, on the ground that the matrimonial disputes between petitioner No. 1 and respondent No. 2 have been amicably settled.
3. Issue notice. The learned APP for the State accepts notice on behalf of the State.
4. The petitioners and respondent no. 2 are present before this Court and have been duly identified by the concerned Investigating Officer [IO].
5. Briefly stated, petitioner No. 1 and respondent No. 2 were married on 09.12.2012. Matrimonial disputes arose between them, pursuant to which respondent No. 2 lodged the aforesaid FIR. Upon completion of the investigation, a charge-sheet was filed against petitioner No. 1.
6. During the pendency of the proceedings, the parties amicably resolved their disputes before the Delhi Mediation Centre, Dwarka Courts, vide Settlement Agreement dated 04.10.2025. In terms thereof, their marriage was dissolved by a decree of divorce by mutual consent on 28.01.2026. Petitioner No. 1 agreed to pay ₹4,00,000/- to respondent No. 2 in full and final settlement of her claims, of which the final instalment of ₹1,00,000/- was payable at the time of quashing of the FIR.
7. On a query made by this Court, respondent No. 2, who has been duly identified by the Investigating Officer, states that she entered into the Settlement Agreement dated 04.10.2025 of her own free will and without any pressure, coercion, undue influence or threat. She further states that she has no objection if the aforesaid FIR is quashed.
8. Learned counsel for the petitioners submits that, in terms of the settlement, the balance settlement amount of Rs. 1,00,000/- (Rupees One Lakh only) has been handed over to respondent no. 2 today in Court by way of Demand Draft No. 539359. It is further submitted that, with the said payment, the entire settlement amount stands paid and the terms and conditions of the settlement have been fully complied with. Nothing further remains payable by either party under the settlement.
9. In view of the above, since the parties have amicably resolved their differences of their own free will and without any pressure, coercion, undue influence or threat, no useful purpose would be served by continuing the proceedings. Rather, continuation of the proceedings may only give rise to further acrimony between the parties. In these circumstances, this Court is of the view that the interest of justice would be served by bringing the proceedings to an end. Accordingly, the aforesaid FIR and all proceedings arising therefrom are liable to be quashed.
10. Accordingly, FIR No. 101/2017 dated 04.08.2017, registered at Police Station Crime (Women) Cell, Nanak Pura, for the offences punishable under Sections 498-A, 406, 506 read with Section 34 IPC along with all consequential proceedings emanating therefrom, are hereby quashed.
11. Therefore, the present petition is allowed and thereby, disposed of.
12. The pending application also stands disposed of.
13. A copy of this order be sent to the concerned learned Trial Court for necessary information and compliance.
14. The order be uploaded on the website forthwith. MADHU JAIN, J SEPTEMBER 24, 2026/ys/PG
