1. This hearing has been done through hybrid mode.

2. The present petition has been filed by the Petitioner under Article 226 of the Constitution of India, inter alia, seeking issuance of an appropriate writ directing the Registrar Cooperative Societies (hereinafter, 'RCS') to consider and decide the proposal relating to approval of the Petitioner’s name for allotment of flat in the Delhi Union of Journalists CGHS Ltd. (hereinafter, ‘Society’).

3. In the present case, the only issue is in respect of implementing the order dated 15th September, 2010, passed by the ld. Single Judge, qua the Petitioner. The said order clearly records that the dues of the Petitioner were a sum of Rs.7,69,782/-. The relevant portion of the said order is as under:

4. The said amount was modified in terms of the order dated 8th December, 2017 passed by the Supreme Court in SLP(C) 33061/2015 titled ‘P.K. Yadav & Ors. v. Ramesh Saini, President, Delhi Union of Journalist Cooperative Group Housing Society ltd.and Ors.’ . The said order reads: “Heard the learned counsel appearing for the parties. It is clear that by the order that was sought to be reviewed, namely, the order dated 11.04.2012, the High Court in awarding 18% awarded interest on delayed payment obviously did not notice Rule 32 which says that the rate of interest is to be on a graded scale up 10%. No doubt, the Review Petition was filed extremely belatedly but we fell that, in the interest of justice, the principle of the statutory rule must be followed. We, therefore, substitute the rate of 18% with the rate of 10% interest. The special Leave Petition is disposed of to the aforesaid extent.” Pursuant to the above order of the Supreme Court, a sum of Rs.8,48,663/- has been deposited by the Petitioner. It is stated that there are no other dues qua the Petitioner.

5. On 10th September, 2026, notice was issued in the matter and Mr. Shashi Pratap Singh, ld. Counsel was requested to accept notice on behalf of the RCS, and seek instructions in the matter.

6. Today, after seeking instructions, Mr. Shashi Pratap Singh, ld. Counsel for RCS submits that repeated letters have been written to the Society to clear various deficiencies of the Society’s documentation.

7. No one has appeared on behalf of the Society, despite service. The Society, has already, vide a letter dated 26th October, 2025, confirmed that the Petitioner is a founder and bona fide member of the Society, holding membership number 91 since 1986. The relevant portion of the said letter is extracted below:

8. The Court has considered the matter. The deficiencies of the Society cannot be saddled upon the Petitioner in this manner. If the Society is not clearing the deficiencies, the further processing of the Petitioner’s membership cannot be held up in this manner.

9. Accordingly, the following directions are issued:

(i) The Petitioner or any of his family members, with requisite documents, along with the President/Secretary of the Society shall appear before the RCS on 5th October, 2026 at 11:30 a.m.

(ii) On the said date, one of the office bearers of the Society shall appear along with the documents qua the Petitioner and state if they have any objections.

(iii) The RCS shall ensure that it shall not raise any other objections qua the Society’s non-compliances, in order to hold back the recommendation to the Delhi Development Authority (hereinafter, ‘DDA’), qua the Petitioner.

(iv) After a decision is made by the RCS, the recommendation shall be sent to the DDA by 31st October, 2026.

(v) Let a copy of the present petition be sent by Mr. Shashi Pratap Singh, ld. Counsel for the RCS to the RCS.

10. The present petition is disposed of in these terms. All pending applications, if any, are also disposed of. PRATHIBA M. SINGH, J DINESH BHATT, J SEPTEMBER 24, 2026 Rahul/sm
