1. This hearing has been done through hybrid mode. CRL.M.A. 29872/2026 (exemption)

2. Allowed subject to all just exceptions. The application is disposed of. CRL.M.C. 7148/2026

3. By way of the present petition filed under Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (hereinafter referred to as the ‘BNSS’), read with Article 226 of the Constitution of India, the petitioner seeks quashing of FIR No. 1390/2015, registered at P.S. Neb Sarai, Delhi, under Sections 498A/406/34 of the Indian Penal Code, 1860 (hereinafter referred to as the ‘IPC’), and all consequential proceedings arising therefrom, on the basis of the amicable settlement arrived at between the petitioner and Respondent No.

2.

4. The Respondent No. 2 is present before this Court and has been duly identified by the Investigating Officer as well as her respective learned counsel.

5. Briefly stated, the petitioner and Respondent No. 2 were married on 31.07.2016. A female child was born out of the wedlock, whose custody is presently with Respondent No. 2. FIR No. 1390/2015 came to be registered at P.S. Neb Sarai on the complaint of Respondent No. 2 against the petitioner and his family members for offences punishable under Sections 498A/406/34 IPC.

6. It is further stated that the parties have since amicably resolved their disputes. A Settlement Agreement dated 25.04.2025 was executed between the parties on 29.04.2025. The marriage between the petitioner and Respondent No. 2 has also been dissolved by a decree of divorce by mutual consent under Section 13B(2) of the Hindu Marriage Act, 1955, dated 27.09.2025.

7. Learned counsel for the petitioner submits that, pursuant to the settlement arrived at between the parties, the entire settlement amount has been paid to Respondent No. 2. It is submitted that the final amount of ₹1,00,000/- has been handed over to Respondent No. 2 today in Court by way of Demand Draft bearing No. 209408. It is further submitted that with the aforesaid payment, the terms and conditions of the settlement stand fully complied with and nothing further remains payable by the petitioner to Respondent No. 2 under the settlement.

8. On a query made by this Court, Respondent No. 2, who has been duly identified by the Investigating Officer and her learned counsel, states that the disputes between the parties have been amicably resolved and that she has entered into the settlement voluntarily, without any force, coercion or undue influence. She further states that she has received the entire settlement amount, including the aforesaid amount of ₹1,00,000/- by Demand Draft bearing No. 209408, and that she has no surviving claim against the petitioner. She has no objection if the present FIR and all proceedings emanating therefrom are quashed.

9. In view of the settlement between the parties, the dissolution of the marriage, the payment of the entire settlement amount and the categorical statement of Respondent No. 2 that she does not wish to pursue the present proceedings, continuation of the criminal proceedings would serve no useful purpose. The dispute being essentially matrimonial in nature, the continuation of the proceedings would only prolong the litigation between the parties.

10. Accordingly, FIR No. 1390/2015, registered at P.S. Neb Sarai, Delhi, under Sections 498A/406/34 IPC, and all consequential proceedings emanating therefrom, are hereby quashed.

11. The present petition, along with pending application(s), if any, stands disposed of.

12. A copy of this order be communicated to the concerned learned Trial Court for necessary information and compliance.

13. The order be uploaded on the website forthwith. MADHU JAIN, J SEPTEMBER 24, 2026/prg/P
