1. This hearing has been done through hybrid mode.

2. The present petition has been filed under Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023 [hereinafter referred to as ‘BNSS’], seeking quashing of FIR No. 190/2015 dated 16.04.2015, registered at Police Station Swaroop Nagar, District North-West, Delhi, under Sections 363 and 376 of the Indian Penal Code, 1860 [hereinafter referred to as ‘IPC’] and Section 6 of the Protection of Children from Sexual Offences Act, 2012 [hereinafter referred to as ‘POCSO Act’], along with the proceedings arising therefrom.

3. Issue notice. Learned APP for the State accepts notice on behalf of the State.

4. All the Petitioners and Respondent No. 2 are present before this Court and have been duly identified by their respective learned counsel[s].

5. Briefly stated, the concerned FIR was registered on the complaint of respondent No. 3, alleging that her daughter, respondent No. 2, was a minor when the petitioner took her away and sexually assaulted her. The petitioner states that respondent No. 2 was an adult, that they married on 13.02.2015 and that they have since lived together and have two children. Respondent Nos. 2 and 3 are stated to support quashing of the FIR.

6. On a query made by this Court, respondent No. 2, upon being identified by the Investigating Officer [IO], states that she has been residing with the petitioner of her own free will and has no objection if the aforesaid FIR is quashed.

7. In view of the above, the petitioner and respondent No. 2 are stated to have lived together as a family since 2015 and have two children. Having regard to these circumstances and the stand of respondent No. 2, this Court is of the view that no useful purpose would be served by continuing the proceedings. Accordingly, the aforesaid FIR and all proceedings arising therefrom are quashed.

8. Accordingly, FIR No. 190/2015 dated 16.04.2015, registered at Police Station Swaroop Nagar, District North-West, Delhi, under Sections 363 and 376 IPC and Section 6 of POCSO Act, and all consequential proceedings emanating therefrom, are hereby quashed.

9. Therefore, the present petition is allowed and thereby, disposed of.

10. Pending applications also stand disposed of.

11. A copy of this order be sent to the concerned learned Trial Court for necessary information and compliance.

12. The order be uploaded on the website forthwith. MADHU JAIN, J SEPTEMBER 23, 2026/prg/PG
