1. This hearing has been done through hybrid mode.

2. The present application has been filed under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (hereinafter referred to as the ‘BNSS’), seeking anticipatory bail in FIR No. 115/2026, registered at Police Station Prashant Vihar, Delhi, for the offences punishable under Sections 318(2), 336(3) and 340(2) of the Bharatiya Nyaya Sanhita, 2023 (hereinafter referred to as the ‘BNS’).

3. Learned Senior Counsel for the Applicant submits that the complaint was lodged in December, 2025 and subsequently, an enquiry was conducted and the Applicant was informed that the complaint was being closed. He further submits that subsequently, in May, 2026, about five months later, the present FIR was registered and at the time the enquiry was conducted, the Applicant joined the enquiry five times.

4. Per contra, learned APP for the State submits that the Applicant had not joined the investigation subsequent to the registration of the FIR.

5. Learned counsel for the Complainant strongly opposes the bail application and submits that there are various WhatsApp messages sent by the Applicant to the complainant regarding the complainant becoming a member of BCCI. He further submits that the Applicant even handed over a photocopy of a provisional membership certificate to the complainant showing that the complainant had become a member of BCCI.

6. Heard learned counsel for the parties.

7. It is not in dispute that the complaint was lodged in December, 2025 and subsequently, the FIR was registered in May, 2026. At the time when the complaint was lodged, an enquiry was conducted and the Applicant also joined that enquiry five times. Subsequently, after registration of the FIR and after the protection granted by this Court, the Applicant joined the investigation twice, which is also not disputed.

8. In the facts and circumstances, the order dated 01.06.2026 is made absolute. In the event of his arrest, the Applicant shall be released on anticipatory bail, subject to his furnishing a bail bond in the sum of Rs. 25,000/- with one surety of the like amount to the satisfaction of the concerned SHO/I.O. and subject to the following conditions: i) The Applicant shall join the investigation as and when directed by the Investigating Officer and shall provide his mobile number and permanent residential address to the IO.

(ii) The Applicant shall remain available on the mobile number(s) shared by him with the Police. iii) The Applicant shall not directly or indirectly make any attempt to influence the witnesses or tamper with the evidence in any manner. iv) In the event of any change in his residential address or contact details, the Applicant shall promptly intimate the same to the concerned IO/SHO. v) The Applicant shall not leave the country without prior permission of the learned Trial Court.

9. Accordingly, the present application is allowed in the above terms and stands disposed of. Pending application(s), if any, also stand disposed of.

10. Needless to state, nothing stated hereinabove shall be construed as an expression of opinion on the merits of the case, and the observations made herein are confined to the consideration of the present bail application.

11. The order be uploaded on the website forthwith. MADHU JAIN, J SEPTEMBER 23, 2026/ys/m
