3. The case of the petitioners is that registration of the said Sale Deeds have been refused on the ground that consolidation proceedings in respect of the subject lands are still pending, and the petitioners have not furnished a No Objection Certificate [“NOC”] and/or Land Status Report [“LSR”].
4. Mr. Aviral Jain, learned counsel for the petitioners, submits that the only impediment to the grant of NOC/LSR is the pendency of the consolidation proceedings in respect of the village in question [Village Pooth Khurd]. Mr. Jain cited orders of this Court in Okaya Infocom Pvt. Ltd. and Anr. v. Govt. of NCT of Delhi and Anr.1, Smt. Nirmala Devi and 1 W.P.(C) 12122/2021, decided on 10.11.2023.
Ors. v. Govt. of NCT of Delhi & Anr. and connected matter2, and several subsequent orders3, as well as the Circular dated 14.08.2025 [“Circular”] issued by the GNCTD, whereby the procedure for registration of land documents has been streamlined and registration has been permitted subject to the purchaser undertaking to abide by the outcome of the pending consolidation proceedings.
5. It is also noted that the respective Sale Deeds record that the subject land is not subject to any acquisition proceedings.
6. Learned counsel further submits that the petitioners are agreeable to purchasing the subject land on the aforesaid terms and undertake to abide by the outcome of the consolidation proceedings, without prejudice to the rights and contentions of any third party.
7. In view of the aforesaid submissions, the present writ petitions are disposed of with a direction that registration of the Sale Deeds in question shall not be refused merely on the ground of non-availability of the NOC/LSR. The petitioners shall, however, remain bound by their undertaking to take the subject land, subject to the outcome of the pending consolidation proceedings, and without prejudice to the rights and contentions of any third party. The petitioners shall file affidavits to the aforesaid effect with the Registry of this Court within one week from today, and the same shall also be forwarded to the concerned Revenue Authority.
