W.P.(C) 11788/2026 Page 2 of 2 of India [2024 SCC OnLine SC 965], it has been held that a writ petition is not maintainable against Air India Limited following its privatisation. The said position would admittedly also apply to Air India Express Limited.

3. In view of the aforesaid, Mr. Chaitanya Agarwal, learned counsel for the petitioner, seeks permission to withdraw the present petition, with liberty to avail of such remedies as may be available to the petitioner against his erstwhile employer, Air India Express Limited. He further submits that, insofar as the petitioner may have any independent cause of action or remedy against the DGCA, the petitioner’s right to seek such remedy in accordance with law may be preserved.

4. The petition is accordingly dismissed as withdrawn, with liberty to the petitioner to avail of such remedies as may be available to him in law.

5. It is clarified that this Court has not expressed any opinion on the maintainability or merits of any proceedings that may be instituted by the petitioner in future.
