1. This hearing has been done through hybrid mode.

2. By way of the present petition filed under Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (hereinafter referred to as the ‘BNSS’), the Petitioners are seeking quashing of FIR No. 0289/2023, registered at Police Station Dayalpur, Delhi, for the offences punishable under Sections 498-A and 34 of the Indian Penal Code, 1860 (hereinafter referred to as the ‘IPC’), along with all consequential proceedings arising therefrom, on the basis of an amicable settlement arrived at between the parties.

3. Issue notice. Learned APP for the State accepts notice on behalf of the State.

4. The Petitioners and Respondent No. 2 are present before this Court. Respondent No. 2 has been identified by her counsel as well as the

Investigating Officer (IO) concerned.

5. The Learned counsel for the Petitioner submits that the marriage between Petitioner No. 1 and Respondent No. 2 was solemnized on 29.01.2019 according to Hindu rites and customs in Delhi. After the marriage, the parties resided together as husband and wife; however, owing to differences and misunderstandings, disputes arose between them. Consequently, Respondent No. 2 lodged a complaint before the CAW Cell, Nand Nagri, Delhi, pursuant to which FIR No. 0289/2023 was registered at Police Station Dayalpur.

6. Learned counsel for the Petitioner further submits that during the pendency of the aforesaid proceedings, the parties were referred to the Delhi Mediation Centre, Karkardooma Courts, where they amicably settled their disputes vide Mediation Settlement dated 11.04.2026. Pursuant thereto, the parties have been residing together as husband and wife peacefully since 16.04.2026. The settlement was arrived at for a total amount of ₹1,50,000/- (Rs. One Lakh and Fifty Thousand only), out of which ₹75,000/- (Rs. Seventy-Five Thousand only) was received by Respondent No. 2 through FDR on 17.04.2026, and the remaining ₹75,000/- (Rs. Seventy-Five Thousand only) was paid by Petitioner No. 1 through Demand Draft bearing No. 041207 on 20.07.2026.

7. On a query made by this Court, Respondent No. 2, who has been duly identified by the IO, categorically states that she has entered into the settlement of her own free will, without any force, coercion, or undue influence. She further states that the entire settled amount has been received by her and that she has no surviving claim whatsoever against the Petitioners. She has no objection if the present FIR and all proceedings emanating therefrom are quashed.

8. The Court has considered the submissions made by the parties and has interacted with Respondent No. 2. The parties have resumed cohabitation and are presently residing together. Respondent No. 2 has reiterated before this Court that she does not wish to pursue the present proceedings against the Petitioners.

9. In view of the fact that the parties have amicably resolved all their disputes, the marriage already stands dissolved by a decree of divorce by mutual consent, the entire settlement amount has been paid, and Respondent No. 2 has no objection to the quashing of the FIR, no useful purpose would be served in continuing the criminal proceedings. Rather, continuation thereof would only perpetuate unnecessary litigation between the parties. There is no legal impediment to quashing the FIR in the facts and circumstances of the present case.

10. Accordingly, FIR No. 0289/2023, registered at Police Station Dayalpur, New Delhi, for the offences punishable under Sections 498-A and 34 of the IPC, and all consequential proceedings emanating therefrom, are hereby quashed.

11. The present petition, along with pending application(s), if any, stands disposed of.

12. Copy of the order be communicated to the concerned learned Trial Court for necessary action and compliance.

13. The order be uploaded on the website forthwith. MADHU JAIN, J SEPTEMBER 22, 2026/ys/yt
