1. This hearing has been done through hybrid mode.
2. The present petition has been filed under Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023 [hereinafter referred to as ‘BNSS’], seeking quashing of FIR No. 0500/2025, registered at Police Station Maidan Garhi, District South, Delhi, under Sections 109(1), 110, 118(1) and 3(5) of the Bharatiya Nyaya Sanhita, 2023 [hereinafter referred to as ‘BNS’], and the proceedings arising therefrom, on the basis of a settlement between the parties.
3. Issue Notice. Learned APP for the State accepts notice on behalf of the
State.
4. The Petitioner and Respondent No.2 to 4 are present before this Court and have been duly identified by their respective learned counsel[s] as well as the concerned Investigating Officer [IO].
5. The FIR was registered following an altercation on 28.11.2025 between the petitioners and respondent Nos. 2 to 4, in which the latter allegedly sustained injuries. The parties, who reside in the same locality, subsequently executed a Compromise Deed dated 05.05.2026. The petitioners seek quashing of the FIR and the proceedings arising therefrom on that basis.
6. On a query made by this Court, respondent Nos. 2 to 4, who have been duly identified by the Investigating Officer, have stated that they entered into the Compromise Deed dated 05.05.2026 of their own free will and without any pressure, coercion, undue influence or threat. They have further stated that they have no objection if the aforesaid FIR is quashed.
7. In view of the above, since the parties have amicably resolved their differences, no useful purpose would be served by continuing the proceedings. Their continuation may only give rise to further acrimony between the parties. In these circumstances, this Court is of the view that the interest of justice would be served by bringing the proceedings to an end. Accordingly, the aforesaid FIR and all proceedings arising therefrom are liable to be quashed.
8. Accordingly, FIR No. 0500/2025, registered at Police Station Maidan Garhi, District South, Delhi, under Sections 109(1), 110, 118(1) and 3(5) BNS, and all consequential proceedings emanating therefrom, are hereby quashed.
9. Therefore, the present petition is allowed and thereby, disposed of.
10. The pending application also stands disposed of.
11. A copy of this order be sent to the concerned learned Trial Court for necessary information and compliance.
12. The order be uploaded on the website forthwith. MADHU JAIN, J SEPTEMBER 22, 2026/ys/PG
