3. The case of the petitioners in the present writ petitions is that they have purchased the subject land pursuant to the respective Sale Deeds in question. However, registration of the said Sale Deeds has been refused on the ground that consolidation proceedings in respect of the subject land are still pending and the petitioners have not furnished a No Objection Certificate [“NOC”] and/or Land Status Report [“LSR”]. The petitioners, therefore, seek a direction to the respondent to issue the NOC and/or LSR in their favour so as to facilitate registration of the respective Sale Deeds in respect of the subject property.
4. It is also noted that the respective Sale Deeds record that the subject land has not been notified under Sections 4 and 6 of the Land Acquisition Act, 1894.
5. Learned counsel for the petitioners submits that the only impediment to the issuance of the NOC/LSR is the pendency of consolidation proceedings in respect of the village in question. Reliance is placed on the judgment of this Court in Okaya Infocom Pvt. Ltd. & Anr. v. Govt. of NCT of Delhi & Anr.1 and Smt. Nirmala Devi & Ors. v. Govt. of NCT of Delhi & Anr. & connected matter2, as well as several subsequent orders passed by this Court3 and the subsequent Circular dated 14.08.2025 [“Circular”] issued by the GNCTD, whereby the 1 W.P.(C) 12122/2021, decided on 10.11.2023 [hereinafter, “Okaya”]. 2 W.P.(C) 4046/2025, decided on 01.04.2025. 3 Chandan Sawhney v. State (NCT of Delhi) [2024 SCC OnLine Del 8421]; Vinod Kumar Rajoria v. Government of NCT of Delhi and Others, [2023 SCC OnLine Del 5446].
procedure for registration of land documents has been streamlined and registration has been permitted subject to the purchaser undertaking to abide by the outcome of the pending consolidation proceedings.
6. Learned counsel further submit that the petitioners are agreeable to purchasing the subject property on the aforesaid terms and undertake to abide by the outcome of the consolidation proceedings, without prejudice to the rights and contentions of any third party.
7. Learned counsel appearing for the respondent submit that there is no other impediment to the issuance of the NOC/LSR, and that the judgment in Okaya would be followed in the present case as well.
8. In view of the aforesaid submissions, the present writ petitions are disposed of with a direction that registration of the Sale Deeds in question shall not be refused merely on the ground of non-availability of the NOC/LSR. The petitioners shall, however, remain bound by their undertaking to take the subject property subject to the outcome of the pending consolidation proceedings and without prejudice to the rights and contentions of any third party. The petitioners shall file affidavits to the aforesaid effect with the Registry of this Court within one week from today, and the same shall also be forwarded to the concerned Revenue Authority.
