1. This hearing has been done through hybrid mode.

2. The present petition has been filed by the Petitioner- Sh. Surinder Kumar Chhabra under Article 226 of the Constitution of India, inter alia, seeking directions to the Registrar of Cooperative Societies (hereinafter ‘RCS’) to forward his name to the Delhi Development Authority (hereinafter, ‘DDA’) for allotment of a plot in Mianwali District House Building Society Ltd. (hereinafter ‘Society’).

3. The background of the Petitioner’s case is that the father of the

Petitioner was a member of the Society and had Membership No.419.

4. However, the membership was initially ceased on 24th November, 1987 by the Secretary of the Society. The said cessation was thereafter withdrawn on 19th August, 1991, and the final list of members was also prepared.

5. However, the grievance of the Petitioner is that, since the restoration of membership, the Society has filed repeated representations and letters to the RCS. Despite the same, the RCS has not recognized the membership of the Petitioner or his father. Hence, this petition.

6. Mr. Sandeep Kumar, ld. Counsel for the Petitioner submits that repeated representations and repeated letters by the Society have been of no avail. He, therefore, prays that the RCS be issued a direction for forwarding the name of the Petitioner and recognizing his membership.

7. On the other hand, Mr. Shashi Pratap Singh, ld. Counsel for the RCS, submits that there are various discrepancies in the documents filed by the Petitioner, and the same have to be verified properly.

8. Under these circumstances, and considering these facts, it is directed as under:

(i) The RCS shall call upon the Petitioner, along with all his documents, and the office bearers of the Society, along with all relevant records, for examination. The first meeting shall be held in the RCS office on 14th October, 2026 at 11.30 am.

(ii) Upon examination of the records, if the Petitioner’s membership is found to be genuine, the RCS shall recognise the Petitioner’s membership and take appropriate action for making a recommendation to the DDA.

(iii) If, on the other hand, the documents are not verified or any deficiencies are found, the RCS shall pass a speaking order in the matter.

(iv) The decision in the matter shall be taken by the RCS on or before 31st January, 2027.

(v) Since the Petitioner’s father has already passed away, the RCS may also issue notice to all the legal heirs.

9. All rights and remedies are left open.

10. The petition is disposed of in the above terms. The pending applications, if any, are also disposed of. PRATHIBA M. SINGH, J. VIKAS MAHAJAN, J. SEPTEMBER 18, 2026 aj/sm
