4. It is stated that Respondent No.2 conducted a pre-dispatch inspection of the equipment on 27.03.2023 and thereafter the equipment was delivered to Respondent No.1 by the Petitioner on 21.04.2023. It is stated that a Consignee Receipt Certificate (CRC) acknowledging the equipment had been received in good condition, complete in all respects, was issued by Respondent No.1 on 21.04.2023.
5. It is stated that the Petitioner submitted its claim for 90% of the payment amounting to Rs. 35,04,600/- against the CRC on 22.05.2023, which was acknowledged by Respondent No.1. However, it is stated that Respondent No.1 failed to make the payment.
6. It is stated that in the month of July, 2024 the Petitioner successfully completed installation, commissioning, testing and trial run of the equipment at the premises of Respondent No.1 which was made fully operational to the satisfaction of Respondent No.1. It is stated that Respondent No.1 issued a Final Acceptance Certificate (FAC) to the Petitioner in the month of July, 2024. It is stated that the Petitioner raised its claim for release of 10% payment against the FAC on 12.07.2024.

11. Accordingly, Mr. Abhilash Mathur, Advocate (Mob No: 9811041536) is appointed as the Sole Arbitrator to adjudicate upon the disputes between the parties.
12. The arbitration would take place under the aegis of the Delhi International Arbitration Centre (DIAC) and would be subject to its rules and regulations. The learned Arbitrator shall be entitled to fees as per the Schedule of Fees maintained by the DIAC.
