O R D E R
1. This is an application seeking withdrawal of the present suit i.e., CS(OS) 244/2020. IA No.25234/2026 (UNDER ORDER XXIII RULE 1(3)(b) READ WITH SECTION 151 OF THE CODE OF CIVIL PROCEDURE, 1908 ON BEHALF OF THE PLAINTIFF SEEKING PERMISSION TO WITHDRAW THE PRESENT SUIT WITH LIBERTY TO INSTITUTE A FRESH PROCEEDING ON THE SAME SUBJECT MATTER)
2. The application is predicated on the assertion that the issue of acquisition stands decided by the Supreme Court in proceedings pending before it. However, the same is refuted by Mr. Sanjay Poddar, learned senior counsel, who appears on behalf of the Delhi Development Authority (DDA).
