1. This petition is filed seeking direction to respondent no.2 to re-open the bid window for two hours or for such period as an alternative mechanism to complete the bidding processes.

2. The brief facts are that on 21.07.2026, the Chief Executive Officer (hereinafter ‘respondent no.2’) issued a notice inviting e-tender (for short ‘NIT’) for online bids in two covers i.e. technical and price bid for supply of 17 items of Oxo-Biodegradable Sanitary Napkins, Diapers and other consumable items along with the date sheet. By corrigendum dated 11.08.2026, the bid submission date was rescheduled from 14.08.2026 to 19.08.2026. It is pleaded that the petitioner accessed the e-tender portal on 19.08.2026 but on taking the final step of submission i.e. ‘Encrypt & Upload’, the portal displayed the error message ‘Device Connecting Not

Working’. The attempt to re-load the file failed and a similar error message was displayed. The petitioner on 19.08.2026 sent an email to respondent no.2 pointing out the technical glitches faced and for seeking extension of the bid submission time to upload the documents. Another email was sent on 21.08.2026 and 24.08.2026 and hence, the present petition.

3. Learned counsel for the petitioner submits that the petitioner had prepared the documents on 19.08.2026 and due to a technical glitch the submission could not be completed. Reliance is on the decision of this court in Alps Mining Services (P) Ltd. v. NTPC Ltd. & Anr., 2026 SCC OnLine Del 5798 to submit that in similar facts the prayer for extension of bid submission was accepted by the court.

4. Learned counsel for the respondent no.1 and 2 appears on advance notice.

5. The bids invited were in two covers, namely, technical bid and price bid. On a pointed query from the court, learned counsel for the petitioner fairly submits that technical bid was open on 21.08.2026 as the date for opening technical bids given in NIT was rescheduled to 21.08.2026 by issuing a corrigendum. This petition was prepared on 03.09.2026 i.e. much after the opening of the technical bids.

6. Be that as it may without commenting upon the merits of the controversy, this petition is disposed of with direction to respondent no.2 to consider the email of the petitioner dated 19.08.2026 as a representation and decide it in accordance with law and to take necessary action, if so necessitated. Considering that the technical bid has already been issued, let the needful be done within seven days from today.

7. Let a copy of this order be supplied under the signature of the Court

Master to learned counsel for respondents.
