1. This hearing has been done through hybrid mode. CM APPL. 54258/2026 (for exemption)
2. Allowed subject to all just exceptions. Application is disposed of.
3. The present petition has been filed by the Petitioner-Mr. Chander Mohan Chadha through his General Power of Attorney holder namely, Mr. Ankit Bhasin under Article 226 of the Constitution of India, inter alia, seeking early disposal of the reference petition filed by the Petitioner under Section 18 of the Land Acquisition Act, 1894 seeking enhanced compensation.
4. The brief background of the present case is that Award No.12/2008- 09/SW was passed by the LAC vide which the agricultural land of the Petitioner was acquired for the construction of a 100 meter road for the Planned Development of Delhi.
5. The case of the Petitioner is that the land of the Petitioner falls under Khasra Nos. 149 (4-14), 158/2 (3-19), 156 (4-14) and 157 (4-14) situated at Revenue Estate of Village, Massooda Bad, New Delhi. The same was acquired vide Award No.12/2008-09/SW. The physical possession of the subject land is also stated to have been taken by the Government.
6. A compensation amount of Rs. 80,33,097/- and Rs.28,28,131/- was paid to the Petitioner on 9th March, 2013. The Petitioner was aggrieved by the compensation amount and had filed reference petition under Section 18 of the Land Acquisition Act, 1894 on 30th January, 2013. However, repeatedly the Petitioner is stated to have approached the LAC for forwarding the reference petition filed by the Petitioner under Section 18 of the Land Acquisition Act, 1894 to the ld. District Judge South-West District, Dwarka Court, New Delhi, however, the same was not sent by the LAC. Hence, the present petition has been filed.
7. Dr. Suman Chaudhary, ld. Counsel for the Petitioner submits that reference petition under Section 18 of the Land Acquisition Act, 1894 was filed by the Petitioner on 30th January, 2013. A copy of the same is annexed as Annexure P-4. She submits that the Award number is inadvertently mentioned as Award No.9 wrongly in the Section 18 petition.
8. Mr. Sanjay Kumar Pathak, ld. Standing Counsel for the LAC, on the other hand, takes objection to the General Power of Attorney of the Petitioner which states that it is executed in Delhi but in fact the same has been executed abroad. Secondly, it is submitted by Mr. Pathak, ld. Standing Counsel, that no diary number has been provided by the Petitioner in respect of the application submitted under Section 18 of the Land Acquisition Act, 1894. It is also pointed out by Mr. Pathak, ld. Standing Counsel that the representation filed by the Petitioner incorrectly mentions ‘Award no. 12/2008-09/SW’ as ‘Award no. 9/2008-09/SW’.
9. The Court has heard ld. Counsel for the parties. The General Power of Attorney has been executed by the Petitioner in favour of his real nephew Mr. Ankit Bhasin. The General Power of Attorney has also been legalised at the Consulate General of India, Dubai (UAE). Thus, it cannot be said that there is any discrepancy in the General Power of Attorney. However, there appears to be a typographical error in the General Power of Attorney, as it mentions that the same was executed in Delhi, whereas it was in fact executed abroad.
10. Insofar as the reference petition under Section 18 of the Land Acquisition Act, 1894 is concerned, the said petition has been filed by Mr. Chander Mohan Chadha R/o 27/4, 1st Floor, East Patel Nagar, Delhi but the title of the petition states Award no. 9/2008-09/SW which appears to be a typographical error.
11. The prayer of the Petitioner, is for expediting the reference petition. Accordingly, let the reference petition filed by the Petitioner be processed by the LAC and be sent to the concerned District Judge for the purposes of further adjudication in accordance with law, within three months.
12. If the LAC or the concerned District Judge requires any information from the Petitioner, they may contact the General Power of Attorney holder of the Petitioner, whose details are as under: ●Name-Shri. Ankit Bhasin S/o Shri. Vijay Bhasin ●Address- G-23B Vijay Nagar Opposite Police Line, New Delhi- 110009. ●Mobile No.: 9811121035.
13. The petition is disposed of in the above terms. Pending applications, if any, are also disposed of. PRATHIBA M. SINGH, J. VIKAS MAHAJAN, J. SEPTEMBER 7, 2026/MR/Ck
