1. The accused/applicant seeks regular bail in case FIR No. 841/2023 of PS Mahendra Park for offence under Section 302/201/34 IPC.
2. After addressing partly, learned counsel for accused/applicant seeks permission to withdraw this application with liberty to file afresh before the trial court after testimony of the four eye witnesses is recorded.
3. Learned trial court is requested to ensure expeditious examination of the said eye witnesses since learned counsel for accused/applicant has assured that on behalf of accused/applicant no adjournment shall be sought.
4. Accordingly, the bail application is dismissed as withdrawn with liberty as sought.
