1. This hearing has been done through hybrid mode.

2. The present petition has been filed under Article 226 of the Constitution of India by the Petitioner-Virender Goel, who is engaged in Mehandi work outside the Hanuman Mandir at BKS Marg, New-Delhi, seeking the following prayers:

W.P.(C) 12359/2026

“(1) To issue a writ of mandamus or appropriate writ or direction or order directing the respondents for correcting the place of squatting as Hanuman Mandir Parisar (Compound) in COV No 2025 200869 in term of survey acknowledgment ;

(2) To issue a writ of mandamus or appropriate writ or direction or order directing the respondents for permitting the petitioner for vending and selling ladies wear and cosmetic items in place Mendi Work being mentioned in COV No V 20025 200869, enabling the petitioner to earn the livelihood of his dependents for squatting & vending within compound Hanuman Mandir BKS Marg , New-Delhi -1

(2) And to pass such other and further order or orders as this Hon’ble court deem fit and proper in the interest of Justice.”

3. The case of the Petitioner is that his Certificate of Vending (hereinafter, ‘CoV’) has been issued with the wrong location and he has been squatting for years outside the Hanuman Mandir at BKS Marg, New-Delhi. The photographs of the place of squatting of the Petitioner have been placed on record, which are extracted below:-

W.P.(C) 12359/2026

4. Ld. Counsel for the Petitioner submits that the Petitioner also wishes to sell readymade garments and, therefore, he is also seeking a change in the provisional CoV issued to the Petitioner.

5. Ld. Counsel for the New Delhi Municipal Council (hereinafter, ‘NDMC’) submits that the Petitioner is already carrying out Mehendi services outside the mandir and it is only for the Town Vending Committee-II (hereinafter, ‘TVC-II’) to change the place or the category of the Petitioner.

6. The Court has considered the matter. A perusal of the photographs which are filed would show that there is not adequate space for expansion of the vending site of the Petitioner. Insofar as the change of the location in the CoV is concerned, presently the CoV bearing Vendor ID:V2025200869 issued to the Petitioner, is mentioning ‘Mehdi work’ without any specific location and only mentions ‘Janpath’.

7. Under these circumstances, it is directed that the TVC-II, upon being constituted, shall consider the prayer of the Petitioner and take a decision within 3 months to correct the place of vending.

8. In the meantime, the Petitioner should not be disturbed from rendering his Mehandi services outside the Hanuman Mandir as he is a provisional CoV holder.

9. The petition is disposed of with all pending applications, if any. PRATHIBA M. SINGH JUDGE VIKAS MAHAJAN JUDGE AUGUST 24, 2026/MR/ck
