2. Allowed, subject to all just exceptions. Application is disposed of.

3. The present petition has been filed by the Petitioner under Article 226 of the Constitution of India, inter alia, seeking directions to the Respondent to decide the Petitioner’s application dated 27th August, 2024 seeking release of compensation in respect of the land of the Petitioner, in a time bound manner.

4. The case of the Petitioner pertains to the land comprised in Khasra No.

58/10 (4-16), 58/12/1 (3-12), 58/13 (4-16), 58/14/2 (4-16) and 58/9 (4-16), total admeasuring 22 bighas 16 biswas situated in the revenue estate of Village Khureji Khas, Delhi (hereinafter, ‘the subject land’).

5. The subject land was notified under Section 4 of the Land Acquisition Act, 1894 (hereinafter, ‘the Act, 1894’). This was followed by a declaration under Section 6 of the Act, 1894, which was issued on 29th July, 1970.

6. Based on the aforesaid notifications, the Land Acquisition Collector is stated to have pronounced the Award No.22/70-71 dated 29th July, 1970 under Section 11 of the Act, 1894 and the market value of the subject land was determined as Rs. 1100/- per bigha.

However, since an application has been made, let the Land Acquisition Collector hear the Petitioner, call for all the relevant records, verify the credentials of the Petitioner, and thereafter pass an order on the application made by the Petitioner.

10. Needless to add, this Court has not examined the rights of the Petitioner, if any, to the said land or the entitlement of the Petitioner to the compensation.

11. The application be decided by the LAC within a period of 6 months from this order.

12. All rights and contentions of the parties are left open.
