% 19.08.2026 CRL.M.A. 25399/2026 (for early hearing)
1. This application has been filed by the petitioner seeking early hearing of the captioned writ petition, which is next scheduled to be listed on 31.08.2026.
2. Mr. Yasir Rauf Ansari, learned Additional Standing Counsel for the State, and Mr. Shiv Chopra, learned counsel for respondent No. 2, are both present.
3. For the reasons stated therein, the application is allowed, and the writ petition is taken up on Board, with the consent of learned counsel for the respondents.
4. The application, accordingly, stands disposed of. W.P.(CRL) 1690/2026
5. By way of this writ petition under Article 226 of the Constitution, the only relief sought by the petitioner is for a direction upon the learned Family Court, which is in seisin of execution proceedings filed by the petitioner, to consider her application for early hearing of the execution petition and execute an interim maintenance order dated 10.03.2025, passed by the learned Family Court.
6. Ms. Sowjhanya Shankaran, learned counsel for the petitioner, submits that the interim maintenance granted by the learned Family Court vide order dated 10.03.2025 has been upheld by this Court vide order dated 09.07.2025 and by the Supreme Court vide order dated 30.01.2026.
7. However, according to Ms. Shankaran, respondent No. 2 remains in arrears of payments, for which purpose the petitioner has instituted Criminal Execution No. 103/2025, which is presently pending before the learned Family Court.
8. Mr. Chopra submits that the execution proceedings are, in fact, progressing at pace. However, he submits, without prejudice to the rights and contentions of respondent No. 2, that respondent No. 2 has no objection to consideration of the execution proceedings, as may be directed by the Court. Mr. Chopra also states that respondent No.2 will not seek any unnecessary adjournments before the learned Family Court.
9. The petition, alongwith pending application, is disposed of with a request to the learned Family Court to consider the execution proceedings as expeditiously as practicable, having regard to its own Board.
10. Next date of hearing already fixed, i.e. 31.08.2026, stands cancelled. PRATEEK JALAN, J AUGUST 19, 2026 “B”/MK/
