18.08.2026 CRL.M.A. 25204/2026 (for exemption) Exemption allowed, subject to all just exceptions. The application stands disposed of. CRL.M.A. 25205/2026 (for condonation of delay in re-filing) This is an application for condonation of 12 days’ delay in re-filing the captioned petition. For the reasons stated therein, the application is allowed, and the delay is condoned. The application stands disposed of. W.P.(CRL) 2492/2026

1. The petitioners have filed this petition under Article 226 of the

W.P.(CRL) 2492/2026

Constitution, for the following relief: “i. Allow the instant Petition; ii. Issue a Writ Prder or direction in nature of a Mandamus Writ, thereby directing the Respondent No. 1 to 2 to take legal action against the ACP/SHO PS Laxmi Nagar and also direct a fair investigation against the false implication of Petitioners who have been framed in the FIR No. 105/2026 PS Laxmi Nagar U/S 115(2) and 79, BNS, 2023; iii. Order that impartial investigations be conducted by another PS other than the PS Laxmi Nagar, under the superintendence of the Ld. Metropolitan Magistrate having the competent jurisdiction, for the various complaints filed by the Petitioners at PS Laxmi Nagar; iv. Pass any other appropriate Order or further Orders as this Hon'ble Court may deem fit and proper on the facts and circumstances of the case, in favour of the Petitioners and against the Respondents in order to give complete justice to the case.”

2. Prayer (ii) relates to FIR No. 105/2026, which has been registered against petitioner No. 1 at the instance of the complainant, who has not been made party to the present writ petition. The FIR is still under investigation, and it is yet unknown as to whether the Investigating Officer will consider it appropriate to press charges against the petitioners or not. In such circumstances, Mr. Shayuk Kumar, learned counsel for the petitioners, states that the petitioners reserve the rights and remedies available to them in law, as far as the proceedings arising out of the said FIR are concerned.

3. Prayer (iii) relates to several complaints made by the petitioners against respondent Nos. 3 to 5 which, according to the petitioners, have not been properly investigated, and no FIR has been registered. As far as this aspect is concerned, the petitioners have a remedy before the Magistrate under Section 175(3) of the Bharatiya Nagarik Suraksha Sanhita, 2023. Mr. Kumar therefore does not press this prayer and

submits that the petitioners will approach the concerned Magistrate in accordance with law.

4. As no further orders are sought in this writ petition, it stands disposed of in terms of the aforesaid submissions.

5. It is made clear that this Court has not issued notice to any of the other parties, and the observations in this order are not intended to make any comment upon the veracity of the allegations. PRATEEK JALAN, J AUGUST 18, 2026 ‘pv’/AD/
