1. By order dated 29.07.2026, regular bail was granted to the petitioner on the conditions mentioned therein, in connection with FIR No. 54/2026, dated 21.01.2026, registered at Police Station Ambedkar Nagar, District South, Delhi, under Section 20 of the Narcotic Drugs and Psychotropic Substances Act, 1985 [“the NDPS Act”].

2. However, the proceedings were kept pending upon taking note of the fact that there were significant discrepancies between the information placed before the Court in the status report dated 06.05.2026, with regard to the petitioner’s prior criminal involvements, and a subsequent status report pursuant to the orders of the Court.

3. The Court therefore directed as follows: “17. The aforesaid notation in the PCIR1 ex facie suggests that the PCIR is not to be submitted to Courts, and the facts of the present case show that the prosecution was unable to verify the data reflected therein. In these circumstances, it is necessary for a considered decision to be taken at the appropriate level, as to whether the aforesaid reports are to be used in Court cases at all, and if not, necessary instructions must be given to the concerned officers not to submit such reports to any Court.

18. For this purpose, the Deputy Commissioner of Police [Litigation] is directed to take up the matter at the appropriate level, and place the stand of the State before this Court.”

4. Mr. Hitesh Vali, learned Additional Public Prosecutor, has today handed over two status reports, one signed by the Deputy Commissioner of Police, Legal [“DCP (Legal)”] and other signed by the Deputy Commissioner of Police, South [“DCP (South)”]. These status reports are taken on record.

5. In the status report submitted by DCP (Legal), it is stated that the detailed Standard Operating Procedure with regard to presentation of previous involvements / conviction reports have been prescribed under orders/circulars dated 29.01.2021, 04.09.2021, and 14.02.2023. Further, pursuant to the observations of this Court in the aforesaid order dated 29.07.2026, further communication has been issued in this regard on 12.08.2026, requiring adherence to the aforesaid circulars and instructions.

6. The status report submitted by DCP (South) states that instructions have been issued to all the Investigating Officers [“IO”] within the South 1 Previous Conviction/Involvement Report.

District and show cause notices have been issued to the concerned IO and the Station House Officer in the present case, as incorrect information was incorporated in the status report filed before this Court. It is further stated that the matter has been taken up at the level of Police Headquarters, and directions have been issued to all districts and investigation units.

7. In view of the aforesaid status reports, no further directions are called for in these proceedings.

8. The application is disposed of. PRATEEK JALAN, J AUGUST 18, 2026 ‘pv’/AD/
