1. The accused/applicant seeks regular bail in case FIR No. 313/2024 of PS Vasant Kunj for offence under Section 365/392/397/411/34 IPC.

2. After last date, status report was filed. I have heard learned counsel for accused/applicant and learned APP for State.

3. Broadly speaking, the allegation against the accused/applicant is that he was involved in a robbery, in which the role assigned by prosecution to the accused/applicant is that he drove the vehicle in which the co-accused GIRISH KATHPALIA

was present and they robbed the complainant de facto.

4. Learned counsel for accused/applicant submits that there is an inordinate delay in lodging of complaint that led to registration of the FIR, so the accused/applicant deserves bail. Further, it is contended that the accused/applicant was arrested solely on the basis of disclosure statement of the co-accused.

5. Learned APP for State, assisted by IO/SI Naveen, opposes the bail application on the ground of the severity of offence and also contends that the Test Identification Parade (TIP) with regard to the accused/applicant was successful. Further, it is submitted by learned APP that the accused/applicant is involved in other cases as well, so be not granted bail.

6. Admittedly, the only evidence against the accused/applicant is the disclosure statement of co-accused. Further, the alleged robbery took place on 07.06.2024 but the FIR was registered on 15.06.2024, regarding which delay, there is no explanation from prosecution side. Rather, it is this delay in itself, which throws doubts about the strength of the TIP, though on this aspect the trial court shall take an independent view on the basis of evidence adduced. In the remaining cases, admittedly, the accused/applicant is on bail. The accused/applicant was arrested on 16.06.2024 and cannot be kept in jail endlessly.

7. The application is allowed and the accused/applicant is directed to be released on bail subject to his furnishing a personal bond in the sum of Rs.10,000/- with one surety in the like amount to the satisfaction of the Trial Court.

8. A copy of this order be immediately transmitted to the concerned Jail Superintendent for informing the accused/applicant.
