1. Today Mr. N Prabhakar, learned counsel appearing for National Buildings Construction Corporation(NBCC) submits that a decision in terms of the Corrigendum No.5 dated 11.08.2026 has been taken whereby the subject tender stands cancelled. He earnestly urges that in view of the cancellation of the subject tender, the petition does not survive anymore.
2. A copy of corrigendum dated 11.08.2026 has been given to the Ms.Madhavi Divan, learned Senior Counsel appearing for the petitioner as also to Mr.Farman Ali, learned CGSC appearing for Power Finance Corporation (PFC). The copy of the corrigendum is taken on the record.
3. Ms. Divan, learned Senior Counsel appearing for the petitioner, on instructions states that the petitioner would challenge the cancellation of the tender by amending the writ petition.
4. On the other hand, Mr. Ali, learned counsel appearing for the PFC submits that NBCC has not consulted PFC before cancelling the tender and in the facts of the case, before proceeding further including withdrawal/re- tendering, NBCC be directed to first bring complete clarity on the contested qualified conditions under NIT. In this context, he has also made a reference to the email dated 11.08.2026 sent by PFC to NBCC.
5. In view of the above position, we dispose of this petition as infructuous, but by granting liberty to the petitioner to file a fresh petition with appropriate prayers taking all pleas available both on facts and in law.
6. Vide order dated 24.07.2026, this Court had directed that till the next date of hearing, the LOI/LOA shall not be issued to the successful party.
7. Considering the cancellation of the subject tender, it is observed that the interim order dated 24.07.2026 has lost its significance and no further directions are called for.
8. Pending applications are disposed of on having become infructuous. V. KAMESWAR RAO, J MANMEET PRITAM SINGH ARORA, J AUGUST 12, 2026 M
