1. By way of the present petition under Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023, the petitioner assails a summoning order dated 15.01.2020 passed by the Magistrate’s Court, and seeks quashing of Complaint Case [NI Act] No. 850/2020, instituted by the respondent - complainant, under Section 138 of the Negotiable Instruments Act, 1881.
2. Mr. Nehal Kashyap, learned counsel for the petitioner, submits that this petition has been rendered infructuous, and therefore seeks permission to withdraw the petition.
