1. The present application under Section 39 of the CPC read with Order XXIV Rule 2 of Delhi HIgh Court Rules 2018 has been filed on behalf of the Decree Holder for transfer of the Decree dated 31.01.2023 passed by this Court in CS(COMM) 690/2021 titled as TKW Management Solutions Pvt. Ltd. v. Sherif Cargo & Anr., to the High Court of Madras.
2. It is stated that there are no properties in Delhi and the only property available to the Judgment Debtor is an office premises at Teynampet, Chennai, Tamil Nadu and all the movable assets are also in Chennai. Learned Counsel for the Decree Holder states that the Decree should be now transferred to the City Civil Court, Chennai, Tamil Nadu. In view of this, this Court is inclined to transfer the Decree dated 31.01.2023 passed by this This is a digitally signed order.
