1. This hearing has been done through hybrid mode.

2. The present petition has been filed by the Petitioner-Ram Samugh under Article 226 of the Constitution of India, inter alia, seeking directions to the Respondents to issue the Certificate of Vending (hereinafter, ‘CoV’) under Section 4 of the Street Vendors (Protection of Livelihood and regulation of

Street Vending Act), 2014.

3. The Petitioner is stated to be a vendor vending from the open Space, adjoining Paras Cinema Wall, near Nehru Enclave Metro Station Gate No. 2, Central Zone, Ward-S-90, New Delhi.

4. According to the Petitioner, he has been surveyed in the recently conducted survey in 2021, and the survey acknowledgment receipt bearing No. 7997197 has also been received.

5. On the last date of hearing i.e., on 10th July, 2026, notice was issued in this matter to the Municipal Corporation of Delhi (hereinafter, ‘MCD’).

6. Today, Ms. Kalra, ld. Counsel for the MCD has entered appearance and submits that the provisional CoV has not been issued to the Petitioner but the Petitioner would be an eligible vendor as there is an acknowledgement receipt which has been placed on record. Ld. Counsel for the MCD, however, points out that the Petitioner claims to be vending outside Paras Cinema which is in Nehru Place, which is a ‘No-vending Zone’.

7. Reliance is placed upon the order dated 2nd February, 2026 in W.P. (C) 1351/2026 titled ‘Mohd. Sageer v. Municipal Corporation of Delhi & Ors.’, wherein this Court has clearly considered the entire matter relating to Nehru Place and has observed that Nehru Place is a ‘No-vending Zone’.

8. Ms. Kalra, ld. Counsel for the MCD further submits that the Petitioner is free to keep a mobile vend in the same zone, however, not in the Nehru Place area which is a ‘No-vending Zone’.

9. Under these circumstances, the prayer sought by the Petitioner is rejected. However, since the Petitioner is stated to be an eligible vendor, the concerned Assistant Commissioner, MCD shall identify a space from where the Petitioner can vend and the same shall be communicated to the Petitioner.

However, this shall be subject to the Petitioner complying with all the terms and conditions of the CoV generally issued to the vendors.

10. It is made clear that the case of the Petitioner shall be considered for issuance of a CoV after the Town Vending Committee–II is constituted. However, the above stated directions shall be subject to any plan which the Town Vending Committee–II may be coming up with in terms of Section 21 of the Street Vendors (Protection of Livelihood and Regulation of Street Vending) Act, 2014 and no vested rights shall be claimed.

11. At this stage, ld. Counsel for the Petitioner submits that the CoV of the Petitioner would be in the category ‘Food/Snacks with gas cylinder/fire’. If so, the Petitioner shall make the representation to the Town Vending Committee–II for issuance of CoV in the said category.

12. It is made clear that upon the Petitioner being issued a CoV, the category for the same shall also be properly mentioned by the MCD.

13. The petition is disposed of in these terms. Pending applications, if any, are also disposed of. PRATHIBA M. SINGH, J. VIKAS MAHAJAN, J. JULY 20, 2026 dj/ck
