1. The present writ petition has been filed against the order dated 12th February, 2026, passed by the Labour Department, Central District, New Delhi Commissioner under the Employee’s Compensation Act, 1923 (“Employee’s Compensation Act”), in the claim, being ICEC/CD/04/2020/575 filed by the respondent herein.

2. This Court notes the objections raised by learned counsel appearing for the respondent that a writ petition would not lie against the order passed under the Employee’s Compensation Act, and that an appeal is required to be filed, in terms of Section 30 of the Employee’s Compensation Act.

3. Learned counsel appearing for the petitioner seeks to withdraw the present petition, with liberty to file appropriate statutory appeal. This is a digitally signed order. The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above. The Order is downloaded from the DHC Server on 13/07/2026 at 16:12:34

4. Accordingly, the present petition is dismissed, as withdrawn, with liberty to file statutory appeal, in terms of the Employees Compensation Act.

5. Pending application also stands disposed of.
