3. Notices of this O.A. were issued to the defendants and they also appeared through respective counsels. However, defendant no. 1 did not choose to file any WS.

Accordingly, the said OA was disposed off vide Order dated 31.03.2022 of the Tribunal with liberty to the parties to revive the same in case of any court order, NCLT order or otherwise any need or any exigency to revive the same.

Thereafter, MA No. 72/2022 (after transfer to this Tribunal re-numbered as TMA no. 03/2024 ) was filed by the applicants praying therein to recall the Order dated 31.03.2022 passed in the OA proceedings to its original number against Defendants no. 2 & 3 which was allowed vide order dated 29.02.2024 & the OA was revived.

Since, defendant no. 1 did not chose to file any WS neither before disposal of OA nor after revival of OA qua defendant no. 1, hence, the case of applicant banks remained uncontested by defendant no. 1.

3.4 Defendants no. 2 & 3 have raised following main objections in their common WS:-

- (i) Defendants no. 2 & 3 have raised an objection that the applicant bank is trying to get relief qua one claim at multiple foras and in multiple proceedings i.e. before this Tribunal as well as before Ld. NCLT, Delhi;
