1. This hearing has been done through hybrid mode.

2. The present petition has been filed by the Petitioner seeking quashing of the attachment order dated 26th November, 2015 passed by the Assistant Collector, Section-II & Recovery officer, Office of Registrar of Cooperative Societies, New Delhi, which is based on the award dated 23rd August, 2003 passed by ld. Arbitrator in Arbitration Case No. 10172/AR/2002-03.

3. According to the Petitioner, the Society – M/s Mayur Bagh Cooperative Group Housing Society Limited (hereinafter ‘Society’) did not have proper management for several years and hence, this attachment order dated 26th November, 2015 is being challenged belatedly. As per the ld. Counsel for Petitioner, the Petitioner has already been issued a due certificate on 12th June, 2024.

4. Ld. Counsel for the Society, on the other hand, submits that there are no outstanding demands against the Petitioner’s flat. This is a digitally signed order. The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above. The Order is downloaded from the DHC Server on 02/06/2026 at 11:43:42

5. A perusal of the impugned order would show that the same is passed on the basis of the premise that there are outstanding dues of the Petitioner towards the Society. However, as of 2024, all outstandings appear to have been cleared. In view thereof, the impugned attachment order dated 26th November, 2015 is quashed and set aside.

6. The petition is disposed of in these terms. All pending applications are also disposed of. PRATHIBA M. SINGH, J. MADHU JAIN, J. MAY 29, 2026 Rahul/ss This is a digitally signed order. The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above. The Order is downloaded from the DHC Server on 02/06/2026 at 11:43:42
