1. It is not in dispute that the Applicant is eligible for arrears of Family Pension in terms of PCDA (P) Circular No 631 dt 05.03.2020. However, during the course of arguments, proxy Counsel for the Respondents (R4&5) submitted that the Pension Account details of the Applicant have not been mentioned in the OA, therefore, they are unable to make payment of the arrears to the Applicant. Learned Counsel for the Applicant vehemently opposed the statement of the Counsel for the Respondents (R4&5) and submitted that firstly the Applicant is in receipt of Family Pension from Respondent No-5 and, secondly the Account No and name of the PDA is clearly mentioned in Cause Title of the OA itself.

OA No 423/2021 Smt Raj Piyari Vs UOI & Ors

2. In view of the aforesaid facts, we direct the Respondents (R4&5) to grant Family Pension to the Applicant in terms of PCDA (P) Circular No 631 dt 05.03.2020 within a period of eight weeks, failing which the Applicant shall be entitled to a cost of Rs. 5000/-.

3. The OA is ordered accordingly. Pending Miscellaneous Application(s), if any, also stand disposed off.
