1. During the course of hearing, Counsel for the Respondents submits that in pursuance of Writ Petition in DB Civil WP No 9476/2024 in the case of UOI & Ors Vs Ex Gnr GD (Reservist) Kana Ram, filed by the Respondents in this matter, the Hon’ble High Court of Judicature for Rajasthan Bench at Jaipur, vide Order dated 01/7/2024, has granted stay in execution of Order dated 31/5/2022 passed by this Tribunal. A copy of ibid Order has been placed on record, which is taken on record.
2. In view of this fact, at this stage the MA Execution is not maintainable. However, the applicant shall be at liberty to file fresh execution application consequent to the final decision of the said DB Civil Writ Petition by the Hon’ble High Court, if so desired.
3. The Application is disposed off accordingly. File be consigned to record.
