**ORDER**

**07.10.2025**

1. It is not in dispute that the Applicant has already been granted MACP-III benefits as prayed for in the OA. However, during the course of arguments, Learned Counsel for the Applicant submits that the pension of the Applicant has not been fixed as entitled to him. Learned Counsel for the Respondents vehemently opposed the contention of Learned Counsel for the Applicant stating that the Applicant has not prayed for fixation of pay/pension in his OA for which the Applicant has to make a fresh representation. The prayer of the Applicant for grant of MACP-III benefits has already been complied with and the OA has become infructuous. In view of the above, the OA is dismissed as infructuous. Pending Miscellaneous Application(s), if any, also stand disposed off.

2. However, we direct that in case the Applicant makes a fresh representation with regard to fixation of pay/pension within a period of one month from the date of receipt of a certified copy of this Order, the Respondents shall consider the case of the Applicant within a period of four months thereafter. The outcome thereof shall be intimated to the Applicant.

3. File be consigned to records.
