1. It is not in dispute that the Applicant is eligible for grant of Pension as applicable to the rank of HonyNb Sub in terms of PCDA (P) Circular No 631 dt 05.03.2020. Learned Counsel for the Respondents submitted that the case has already been settled by Hon’ble AFT (PB), New Delhi vide Order dt20.03.2024 in OA No 589/2019 in the case ofHonyNb Sub Ram Kishan Vs UOI &Ors, and the Applicant is not eligible for grant of Pension as entitled to a regularly promoted Nb Sub to which Learned Counsel for the Applicant raised no objection. In view of the above, the OA is disposed off with direction to the Respondents to verify the facts and in case the Applicant has not been granted arrears of Service Pension/Family Pension for the rank of HonyNb Sub in terms of PCDA (P) Circular No 631dt 05.03.2020, the Applicant shall be granted the same wef 01.01.2006 within a period of four months from the date of receipt of a certified copy of this Order, failing which the Applicant shall be entitled to interest on arrears @6% per annum till the date of actual payment. Pending Miscellaneous Application(s), if any, also stand disposed off.
