3. The Respondents have filed a detailed reply and while not disputing the basic facts presented by the Applicant, they have submitted that the Applicant is eligible for grant of MACP benefits and, accordingly, casualties regarding MACP-II and MACP-III have been published vide Part II Order Nos 1/0716/0004/2021 and 1/2001/0018/2022 respectively. Consequently, LPC- cum-Data Sheet along with its connected documents were forwarded to PAO (OR) AMC for their vetting through manual as well as online but due to technical issues, the same could not be uploaded on SPARSH portal. Therefore, the Record Office has approached PCDA (P) on 31.05.2023 to reconcile the technical issues. Once the technical issue is resolved, the claim of the Applicant shall be processed to PCDA (P).
4. We have heard Learned Counsels for both the parties and perused the material placed before us.
5. It is not in dispute that the Applicant is eligible for grant of MACP benefits and Part II Orders for grant of MACP-II and MACP-II benefits have already been published. However, due to some technical issues, the same could not be uploaded on SPARSH Portal. In view of the aforesaid facts, we direct the Respondents to resolve the technical issues being faced by them and grant MACP-II and MACP-III benefits within a period of three months from the date of receipt of a certified copy of this Order, if not already granted, failing which the Applicant shall be entitled to interest @ 6% per annual on the arrears till the date of actual payment. It is also directed that the benefit of MACP-III and consequent pension revision be done manually, if the technical issues persist.
6. The OA is disposed off accordingly. Pending Miscellaneous Application(s), if any, also stand disposed off.
