ORDER

Date : 07.10.2026

Heard Mr. M. Nibo, learned counsel for the petitioner who submits that despite this Court having granted several opportunities to the respondents, they have not filed counter affidavit till date.

Mr. S. Tapin, learned Senior Government Advocate appearing for the respondent No.1 submits that the petitioner as well as All Puroik Welfare Society had earlier approached this Court by filing WP(C)/483/2022. The said writ petition was disposed of vide order dated 16.08.2024 by directing the Chief Secretary to the Government of Arunachal Pradesh to dispose of the representation dated 17.06.2022 filed by the members of the petitioner’s Society within a period of 2(two) months from the date of receipt of a certified copy of the order. However, as the representation was not disposed of as was directed, the petitioner has filed the instant writ petition. He submits that the Chief Secretary to the Government of Arunachal Pradesh in terms of the direction passed by this Court in the earlier writ petition has considered the representation and disposed of the same with a speaking order on 23.06.2026 rejecting the representation. The learned Senior Government Advocate submits that as per the said order the Department of Tourism cannot unilaterally grant direct appointment to the petitioner in the instant case in the post of Tourism Information Officer without prior approval of the competent authority for relaxation or amendment of the Recruitment Rules. Accordingly, the representation having been considered, the present writ petition has only become infructuous. In support of his submission he has produced a copy of the order dated 23.06.2026. Mr. J. Saro, learned counsel appears on behalf of Mr. N. Pada, learned Standing Counsel, Tourism Department and he adopts the submission made by Mr. S. Tapin, learned Senior Government Advocate. Considering the above position and in view of the order passed by the Chief Secretary on 23.06.2026, the writ petition admittedly has become infructuous.

Accordingly, writ petition stands disposed of as infructuous. The order dated 23.06.2026 produced by Mr. S. Tapin, learned Senior Government Advocate is retained on the record and marked as ‘x’ for identification.
