VERSUS The State of AP and 2 Ors represented by the Commissioner, Department of Environment, Forests and Climate Change, Itanagar. 2:The Commissioner Age: 0 Occupation : Department of Environment Forests and Climate Change Govt of Arunachal Pradesh Itanagar. 3:The Principal Chief Conservator of Forests Age: 0 Occupation : Department of Environment Forests and Climate Change Govt of Arunachal Pradesh Itanagar Advocate for the Petitioner : Dicky Panging, Sr. Adv, Mitin Boko,Dadi Bote Pada,Omor Panggam,Chatung Tajo,Doge Lona,Marge Doji,Daina Tamuk Advocate for the Respondent : GA (AP),

BEFORE HON’BLE MR. JUSTICE NELSON SAILO O R D E R 06.10.2026 Heard Ms. D. Tamuk, learned counsel for the petitioner and also heard Ms. P. Pangu, learned Government Advocate appearing for the respondents. Having regard to the nature of grievance projected by the petitioner, the writ petition is taken up for disposal at the motion stage itself.

2. The petitioner is aggrieved with the order of transfer dated 06.08.2026 (Annexure-2), by which he has been transferred from Tezu Range under the establishment of Divisional Forest Officer, Lohit Forest Division, Tezu to Dirgha Range, which is under the establishment of Divisional Forest Officer, Banderdewa Forest Division. Ms. D. Tamuk, learned counsel for the petitioner submits that due to various issues in his home-front including the education of his child and also medical treatment being given, the petitioner will face great difficulty if he is to proceed to join the new place of posting. The petitioner, therefore, submitted a detailed representation before the Principal Chief Conservator of Forest on 12.08.2026 highlighting as to why he wants to be retained in his present place of posting. However, the said authority has not considered the said representation and taken a decision till date. Aggrieved, the petitioner is before this Court.

3. Learned counsel for the petitioner also submits that despite the order of transfer, since there is none to release the petitioner, he is still holding his present place of posting at Tezu Range. Therefore, she submits that the limited prayer of the petitioner at this stage is for the consideration of his representation in view of the difficulties projected by him in the said representation.

4. Ms. P. Pangu, learned Government Advocate submits that she has no objection if the respondent authority concerned is asked to consider and dispose of the representation.

5. Considering the above, the writ petition is disposed of by directing the Principal Chief Conservator of Forest (respondent No.3) to consider and dispose of the representation of the petitioner dated 12.08.2026 as expeditiously as possible and preferably, within an outer limit of 15(fifteen) days from the date of receipt of a certified copy of this order.

6. Since it is the case of the petitioner that he has not joined the new place of posting as per the impugned transfer order, the respondent authorities shall not insist for him to join the new place of posting until the representation is disposed of as directed hereinabove.
