ORDER

Date : 29.09.2026 (NELSON SAILO, J)

Office note dated 03.09.2026 indicates that an unserved notice report has been received from the Officer-in-Charge, Police Station, Koloriang. Upon perusal of the said notice, it is seen that the family members of the victim has refused to accept the notice without discussion with the accused family. Under the circumstances, we deem it appropriate to declare that the notice is complete. Heard Mr. T. T. Tara, learned Senior Counsel assisted by Mr. G. Bam, learned counsel for the applicant who submits that by filing this application, the applicant seeks condonation of 173 days delay in filing the connected Criminal Appeal. Referring to the application, learned Senior Counsel submits that it was due to bona fide reasons that the appeal could not be filed within the prescribed time limit. He therefore submits that the delay in filing the appeal may be condoned. Ms. T. Jini, learned Additional Public Prosecutor submits that considering the stand taken by the applicant, Court may consider and pass appropriate order as it deem fit. Upon hearing the learned counsel for the rival parties and upon perusal of the materials available on record, we deem it appropriate to condone the delay of 173 days in filing the connected appeal. It is ordered accordingly. The IA stands disposed of.
