ORDER

Date : 06-08-2026 (P. Das, J.)

Heard Ms. O. Taga, learned counsel appearing on behalf of Mr. T. Tapak, learned counsel for the applicant and Ms. T. Wangmu, learned State counsel appearing for the respondents.

2. The instant application has been filed under Section 5 of the Limitation Act, 1963 seeking condonation of a delay of 42 days in preferring the present writ appeal against the judgment and order dated 25.05.2026 passed by the learned Single Judge in WP(C)/39/2026.

3. Perused the grounds for delay enumerated in Paragraph Nos. 3, 4 and 6 of the application.

4. The applicant has contended that on account of his poverty, subsequent illness, and the death of close relatives during the intervening period, there was a delay of 42 days before the writ appeal could be made ready and filed.

5. Mr. Wangmu, learned State counsel, fairly submits that the respondents have no objection to the condonation of the delay.

6. Considering the quantum of delay and the grounds assigned in the application, we deem it appropriate, in the interest of justice, to condone the same. Accordingly, the delay of 42 days in preferring the appeal against the judgment and order dated 25.05.2026 passed by the learned Single Judge in WP(C)/39/2026 is hereby condoned.

7. Interlocutory application stands disposed of.

8. Writ appeal may be listed for admission.
