3. An FIR was lodged on 10.08.2026 before the Officer-in-Charge, Demow Police Station alleging that while the informant was proceeding towards Demow on 09.08.2026 at around 12.40 pm in his Tata Sierra vehicle, it got involved in an accident with a Scorpio vehicle. The accident occurred due to the attempt of overtaking from the opposite side by the Scorpio vehicle. After the accident, both the parties decided to go to the police station. The informant’s cousin brother Adipta Maut went along with the owner of the said Scorpio vehicle towards Demow Police Station. However, instead of going to the Demow Police Station, he took the vehicle to some other place and physically assaulted his cousin brother and thereafter fled away.

4. On the basis of the FIR, Police registered Demow P.S. Case No. 79/2026.

5. The learned counsel for the accused applicant submits that the victim has already been recovered. Since the accused applicant has already spent 65 days behind the bars, the accused applicant should be granted bail.

6. Case diary has been received and the same is perused. The learned Additional Public Prosecutor has opposed the bail prayer.

7. Taking into account the entire facts and circumstances of the case, this Court is of the view that the accused applicant should be granted bail at this stage, as he has already spent 65 days behind the bars.
