Eijaj Ahmed Laskar in connection with Borkhola P.S. Case No.81/2026 registered under Sections 61(2)/308(2)/ 308(5)/318(2)/318(3)/319(2)/112(2)/ 351(2) of BNS, 2023. An FIR was lodged on 11.09.2026 by Dr. Bikash Saudalya Superintendent, Silchar Medical College & Hospital before the Officer-In-Charge Ghungoor Police Outpost alleging that the accusd applicant has been indulging in dalali activities within the premises of Silchar Medical College & Hospital and thereby taking money from the patient in facilitating/arranging MRI investigation. On the basis of the FIR, police registered Borkhola P.S. Case No.81/2026 under the aforementioned Sections. The learned counsel for the accused applicant submits that he, in fact, is not involved in dalali activities but he has been helping the poor patients to get medical services in Silchar Medical College & Hospital. Therefore, he prays that the accused applicant should be granted pre-arrest bail. The learned Additional Public Prosecutor has opposed the pre-arrest bail submitting that he has been taking money from the patients, however, the same was returned to the complainant. Taking into account the materials available in the case diary, this Court is of the view that the accused applicant should be granted pre-arrest bail. Accordingly, it is directed that in the event of arrest of the accused applicant named above, he shall be released on pre-arrest bail on furnishing bail bond of Rs.30,000/- with a surety of like nature to the satisfaction of the Arresting Authority in connection with the aforementioned case, subject to the following conditions:-

(i) the accused applicant shall appear before the Investigating Officer within 10

days from today;

(ii) the accused applicant shall cooperate with the investigation and make himself available as and when called for;

(iii) the accused applicant shall not tamper or hamper with the investigation of the case, in whatsoever manner. In view of the above, the anticipatory bail application stands disposed of.
