Advocate for the Respondent : SC, BANK OF BARODA, BEFORE

HONOURABLE MR. JUSTICE KARDAK ETE

ORDER

Date : 15.10.2026 Heard Mr. S. Mitra, learned counsel for the petitioner. Also heard Mr. M. Dutta, learned Senior Advocate assisted by Mr. L. Deka, learned counsel for all the respondents.

2. Having considered the simple nature of prayer made in this writ petition and as agreed to by the learned counsel for the parties, this writ petition is disposed of at the motion stage itself.

3. The petitioner, who was initially appointed in Junior Management Grade/Scale-I and was subsequently promoted from time to time in various posts and finally to the post of Senior Manager in the Bank of Baroda, was subjected to departmental proceedings. The petitioner was initially placed under suspension on 08.02.2024 in connection with allegations of various irregularities, unusual and suspicious transactions.

4. Following the procedures laid down, the respondent authorities completed the departmental proceedings, pursuant to which the petitioner was imposed with the penalty of dismissal from service by the General Manager, Disciplinary Authority, vide order dated 27.02.2026. Being aggrieved, the petitioner filed an appeal on 12.04.2026 before respondent No. 2, the Chief General Manager- HRM, Appellate Authority, Bank of Baroda.

5. It is the case of the petitioner that, as per the applicable rules, the petitioner's statutory appeal is required to be disposed of within a period of 90 days. However, despite the lapse of 186 days, the statutory appeal filed by the petitioner has not been disposed of. Therefore, the petitioner has prayed that the respondent authorities be directed to consider and dispose of the statutory appeal filed by the petitioner.

6. Having considered the simple nature of the prayer seeking a direction for consideration and disposal of the statutory appeal filed by the petitioner and as agreed to by the learned counsel for the parties, I am of the view that the respondent authorities are deserved to be directed to consider and dispose of the statutory appeal filed by the petitioner as the rule requires that an appeal shall be disposed of within 90 (ninety) days.

7. Accordingly, respondent No. 2, the Chief General Manager, HRM, Bank of Baroda, is directed to dispose of the statutory appeal filed by the petitioner on 12.04.2026 within a period of two (2) months from today.

8. In terms of the above directions, this writ petition stands disposed. JUDGE Comparing Assistant
