ORDER

Date : 14-10-2026

1. Heard Mr. R. Amin, the learned counsel appearing for the accused- applicants. Also heard Mr. M.P. Goswami, the learned Addl. P.P. for the State.

2. This is an application filed under Section 483 of the BNSS, 2023, praying for granting bail to the accused-applicants, namely 1) Amir Ali and 2) Mosiur Rahman in connection with Kalgachia PS Case No.103/2026, registered under Section 20(b)(ii)(B) of the NDPS Act, 1985.

3. An FIR was lodged on 23.09.2026 before the O/C, Kalgachia P.S. by SI(P) Samar Barman to the effect that upon receipt of information, the police apprehended 2 persons, namely Amir Ali and Mosiur Rahman and from their possession 2.019 kg of ganja has been recovered.

4. On receipt of the FIR, the police registered Kalgachia PS Case No.103/2026 under the aforementioned sections.

5. The learned counsel appearing for the accused-applicants submits that since the quantity of ganja recovered is an intermediate quantity and the accused applicants have already spent 22 days behind bars, the accused- applicants should be granted bail.

6. The learned Addl. P.P, on the other hand, opposes the prayer for bail of the accused-applicants.

7. The case diary in the instant case is received and the same has been perused.

8. Taking into account the facts in it’s entirety, this Court is not inclined to grant any relief to the accused-applicants at this stage.

9. Accordingly, the instant bail application is rejected. JUDGE Comparing Assistant
