ORDER

Date : 14.10. 2026 Heard Mr. R. Choudhury, learned counsel appearing for the petitioner. Also heard Mr. B. Sarma, learned Addl. P.P. for the State.

2. The present petition is filed under Section 483 of the BNSS, 2023 for grant of Page No.# 2/2 bail to the petitioner, namely, Khanin Das, in connection with Dispur P.S. Case No. 468/2026 under Section 103 (1) of BNS, 2023, FIR dated 02.07.2026.

3. The petitioner was arrested on 28.07.2026. By the order dated 23.09.2026, this court had called for the Case Diary of the investigation and, by the order dated 06.10.2026, the post-mortem report was called for.

4. The learned Addl. P.P. has submitted that the post-mortem report is awaited.

5. On a perusal of the FIR lodged and the contents of the Case Diary, it appears that the petitioner had been alleged to have caused the death of the victim in a road rage incident where a simple argument escalated into a violent altercation.

6. Having regard to the circumstances of the case, I have found that the custodial interrogation of the petitioner at this stage may not be required. Accordingly, the petitioner shall be allowed to be released on bail on furnishing a bail bond of Rs. 10,000/- with one surety of the like amount to the satisfaction of the learned CJM, Kamrup (M), Assam, who shall be at liberty to impose such other conditions as may be necessary to ensure that the petitioner does not in any manner interfere with the investigation of the case.

7. Accordingly, this bail application stands disposed of. JUDGE Comparing Assistant
