heard Mr. D.P. Goswami, learned Addl. P.P for the State.

2. The present petition is filed under Section 483 of the BNSS, 2023 for grant of regular bail to the petitioners, namely, Shri Ghana Kanta Chutia @ Rajen and Diganta Chutia, in connection with PRC Case No. 89/2026 arising out of Ghilamara Police Station Case No. 43 of 2026 registered under Sections 303 (2)/ 317 (2)/ 3 (5) BNS, 2023 R/W Sections 11 (1) (a) of the Prevention of Cruelty of Animals Act, 1960 R/W Sections 13 91) of the Assam Cattle Preservation Act, 2021.

3. The learned counsel for the petitioner has submitted that the petitioners have been languishing in custody since 03.09.2026 and the charge-sheet has already been submitted in the matter; further custodial interrogation of the petitioners may not be required in the event strict conditions are imposed for their participation in the trial proceedings.

4. The learned Addl. P.P. has submitted that there is sufficient evidence against the petitioner and, therefore, has opposed the prayer for bail.

5. I have heard the learned counsel for the petitioner, and I have perused the scanned copy of the TCR. Given the circumstances that the petitioners are now required to face trial upon completion of the investigation and keeping in view the length of detention, I am inclined to grant the privilege of bail to the petitioners.
