BEFORE

HONOURABLE MR. JUSTICE ARUN DEV CHOUDHURY

ORDER

14.10.2026 Heard Mr. S. Chauhan, learned counsel for the petitioner, who is aggrieved by the refusal of the authorities to issue a trade license. It is contended that the grandfather of the petitioner had a trade license for a rice, oil, and flour mill and that the father of the petitioner is a member of the Karbi Anglong, Autonomous Council. However he has not been granted the license even after the application.

2. Mr. H. S. Bora, learned Standing Counsel, Bokajan Municipal Board, for respondent nos. 4 and 5, on instructions, submits that the Municipal Board is under a legal obligation to grant a license to a citizen if he satisfies the prescribed conditions for the grant of such a license.

3. In the present case, according to the learned counsel for the said

respondents, the petitioner, even after being asked, failed to produce a Next of Kin Certificate. It is submitted that such a certificate is necessary in as much as the entire claim of the petitioner is based on his historical lineage of business with his father and grandfather.

4. Mr. Chauhan, learned counsel for the petitioner, at this stage submits that if that is the reason, he will rectify the defect.

5. In view of the aforesaid consensus, this writ petition stands disposed of permitting the petitioner to rectify the defect as pointed out by the Bokajan Municipal Board, and in the event such defect is cured, the Municipal Authority shall proceed in accordance with law and consider for grant of such a license.

6. The entire exercise shall be carried out by Municipal Board within a period of 2 (two) months from the date of receipt of fresh application or from the date of curing of the defects.
