1. Heard Mr. M. K. Choudhury, learned counsel for the applicant/appellant. Also heard Mr. R. Ali, learned counsel for the opposite party/respondent.
2. This interlocutory application has been filed by the appellants under Order 23 Rule 3 of the Code of Civil Procedure, 1908 praying for passing a compromise decree in view of the compromise executed by the parties on 13.07.2026.
3. It is submitted by the learned counsel for the applicants that during the pendency of the RSA No. 203/2013, the matter has been amicably settled between the parties and to that effect a deed of agreement has also been executed between them on 13th of July, 2026 with certain terms and conditions. The compromise deed has been signed by the parties to this appeal.
4. On the other hand, the learned counsel for the respondent has also submitted that the matter has been amicably settled between the parties and to that effect a compromise deed has also been executed by them on 13th of July, 2026. He also prays that this appeal may be disposed of in terms of the agreement arrived at between the parties.
5. I have considered the submissions made by the learned counsel for both sides and have gone through the materials on record including the deed of

agreement dated 13th of July, 2026 executed between the parties whereby they have agreed to settle the dispute between them amicably.
6. As the matter has been amicably settled, the connected appeal i.e., RSA No. 203/2013 is hereby disposed of on compromise between the parties.
7. Let the decree be prepared accordingly.
8. The deed of agreement dated 13th of July, 2026 shall form part of the decree.
9. This interlocutory application as well as connected RSA No. 203/2013 are accordingly disposed of.
